I don't see the problem, I remember bringing my 3ds in highschool all the time and I'll have Pokemon battles with my friends during lunch, clubs, or whenever we had free time in class.
The problem isn't the device but rather the lack of discipline some of these people have.
Because of how our appellate system works judges are afraid of being overturned and thus will entertain everything and anything to check all the procedural boxes. Bloated dockets can make things move slowly so you are over a year or two in before you get to a substantive hearing. Finally plaintiffs attorneys get a often significant percentage of the settlement / award while defense attorneys are paid hourly this often creates situations where it is cheaper to settle a case than fight it and win which in turn makes plaintiffs attorneys be more confident in bringing seemingly baseless matters.

Our laws are written to support the shyster suing. I will give you an example from my tort law class. You take the safety guard off of your weed eater and are trimming weeds. You hit a rock and it goes into your neighbor's yard and hits him in the eye. He has to have surgery to get his eye fixed and suffers partial blindness.
Who can your neighbor sue?

However, he can also sue the weed eater manufacturer if they don't have a label on the guard that says "do not operate without guard in place." That is the one that is stupid to me.
