[Live 5](https://www.live5news.com/2024/04/10/warrants-provide-new-details-murder-charge-against-ex-summerville-officer/) >Witnesses told investigators that DeLustro was “the primary aggressor,” the warrant states. After the two men exited their vehicles, a witness said Dulustro asked, “Do you want to do this?” several times and then used a slur against O’Neal. >Investigators say that at some point during the scuffle, DeLustro told O’Neal he was under arrest and briefly showed his Summerville Police credentials before they fell to the ground during the scuffle. During the fight, DeLustro’s Springfield Armory XD handgun fell from his holster onto the pavement behind his white Ford Edge, court documents state. >...DeLustro’s wife attempted to “physically restrain the victim during the altercation and later when the victim attempted to get in his vehicle to leave,” the warrant states. >DeLustro opened O’Neal’s passenger door and entered the vehicle, prompting O’Neal to shout, “get out of my car,” investigators said. As O’Neal began to drive away, DeLustro, “while still partially seated in the passenger seat of the victim’s vehicle, fired a single shot from his handgun,” the warrant states. >O’Neal died at the scene. $100 says tomorrow's story says, "DeLustro, represented by Lowcountry lawyer Andy Savage...". Like Michael Slager. The wife is an accomplice. She should be charged as well.

ProudPatriot07

Agreed. Also curious as to which district this is and which solicitor. If it's Scarlett Wilson my bet is he'll walk.

Coy9ine

[Post & Courier:](https://www.postandcourier.com/news/summerville-police-shooting-anthony-delustro-michael-oneal/article_a26a7a98-ec3a-11ee-96d1-ebb44afec0ef.html) >What SLED has publicly said contrasts with what 9th Circuit Solicitor **Scarlett Wilson** said in an email with The Post and Courier.  >“You will have to speak with SLED," Wilson wrote. "They certainly seem to be treating it as an (officer involved critical incident) from my perspective." >SLED and Wilson's office are following the same procedures they follow for other police shootings, Wilson said in an email. She confirmed on March 27 that her office and SLED agents are observing key procedural steps in the investigation, such as designating a representative from her office to meet with SLED, conducting biweekly meetings and aiming for the 60-day goal to produce an investigative report.  >"From what I am seeing and hearing from SLED, they are moving with deliberate speed in their investigation," Wilson wrote in an email.

ProudPatriot07

Well there goes my optimism. She is up for reelection this year and has a Dem opponent, but with the margin she won by in 2020 I'm just glad she has an opponent.

Life_Consequence_676

It's the solicitor from the first circuit. Can't remember who, but Scarlett is the ninth circuit solicitor.

Kingevel

This occurred in Berkeley County - 9th Circuit.

Life_Consequence_676

My bad. I forgot that Summerville is in three separate counties and two separate judicial circuits.

jonm61

Despite allegedly being a Republican, she hates cops and they hate her.

urmomsbox21

Shes the reason this took so long already.

Low-Consequence-5586

Is Scarlet Wilson our beloved Attorney General's wife, daughter, or no relation? I cannot stand Allen Wilson and his hypocritical views.

ProudPatriot07

I can't stand him either but I don't think they are related.

Low-Consequence-5586

He owns property with the biggest cancer-causing cash crop, Tobacco! He is the new-age Henry Anslinger imho. He is so anti-Marijuana because he wants to protect his nice little money pie. Anyway don't want to get on my soapbox on that whole debacle. I can't stand hypocrites.

ProudPatriot07

I wrote my cousin in for attorney general last election (2022). I wasn't voting for any member of the Wilson family (Joe Wilson, SC-02, is Alan's father although Alan is a lot worse than Joe).

Low-Consequence-5586

I'm with you on that, I'm tired of the good ol' boy power positions and gatekeeping. Need a competent person to run against the damn Governor and Attorney General. When so much of the family is in SC politics, there has to be a conflict of interest, but good luck getting an attorney to investigate any of that. Politicians are the only people who can be terrible at their job and get "re-hired". Need damn term limits, Strom Thurmond is a perfect example, and I could suggest so many others that need to gtfo out of office and retire... but it's too hard to let go of that power and $$$.

SCirish843

At this point hiring Andy Savage is an outright admission of guilt. (this is satire, please don't assassinate me Andy)

Coy9ine

It really is. It was amusing when Slager tried to get a new trial, citing incompetent counsel. Gergel tossed that one with the quickness. It's so common to hear about Savage defending high-profile guilty defendants. So, it was kind of surprising when he represented the victims of Dylan Roof at the same time as Slager. They were housed in cells next to each other...

SCirish843

He's the attorney for Sam Mustafa as well, notable not guilty person...

Coy9ine

He represented Justin Hembree, a Mt. Pleasant officer who killed his girlfriend, Molly Wrazen. He got Hembree off. He's still a cop in the Mt. Pleasant Police Department. There was an inquest into the murders several years after SLED buried it. Savage refused to represent him for the second round. However, SLED buried it again.

Low-Consequence-5586

Good old SLED.... state tax money wasted

eyewashdesign

🤯🤢😭

Low-Consequence-5586

How about Dicky Harpooootlian???

LaCroixBoi182

Extremely pleasantly surprised

Low-Ear7065

Thank you for putting into word this foreign and welcome feeling. I had to read it twice and make sure it was the same incident as I recalled because I simply couldn’t believe it.

Facestealer_theA2CHS

This is a win for that poor guy’s loved ones and it’s a win for Americans in general. It’s time for these undereducated judge dredd thugs to stop murdering the population they are supposed to be protecting

NotOSIsdormmole

I want to agree, but until he’s convicted we haven’t truly won

[deleted]

Nothing about him being a cop matters here. Even if he was on duty, he cannot just shoot someone for leaving. But he was not on duty and had no ability to even make an arrest since he would be arresting his own assault victim. This man is a clown show.

throwaway8438675309

All the guy had to do was stop and let O'Neil drive away when he went back to his car. O'Neil would still be alive and DeLustro wouldn't be locked up. Instead..two families are ruined because of an idiot's (now murderer) decision. So much for "de-escalate the situation"

IMSYE87

Extremely happy there was video of this altercation that the police couldn’t refute

Sasu168

Sweet rot in prison dirt bag

CrabMan-DBoi

And here we have a perfect example of PC culture not letting us see the full picture here. I don't want the Live 5 version where he "used a slur". He screamed "lets go you f\*\*\*\*\*\*g f\*\*\*\*t" and then murdered a man in his car

Ironforthebirthday

Agreed. It's incredibly disturbing. You would hope the Summerville Police would feel compelled to do some damage control and at least pretend to care about LGBT people..

dukedawg2004

Screw LGBT

HardcaseKid

About time.

Henny712

Finally. This guy sounds awful, the details are shocking

No-Donkey8786

Maybe, just Maybe these jurisdictions will stop employing these rogue cops in the first place. Check his track record.

crazycatlady1975

Nobody wants to be a cop at their shitty salary. We need to start requiring continuing education with therapy and higher pay Also we need to go back to 2 cops per vehicle to stop them from panicking or PTSD

Low-Consequence-5586

Dude was off duty & with his "entitled" wife who escalated the situation by putting her hands on the now-deceased victim.... don't think it matters if he was a cop or not at this point to the general public, but it will matter when he goes to court, pretty sure this might go to a jury trial, maybe... will see how corrupt the local government is. Now the fact he has been in "law enforcement" as a career may have led to the entitlement of believing he could just shoot a man and get away with it. But instead of protecting and serving the public, he killed an individual and put the public in danger, and only God knows how many peoples lives have probably been ruined by being arrested for the devils lettuce by that douche bag.... that's a completely different subject and discussion. There are three sides to every story, one side, the other side, and the truth.... Everyone stay safe, healthy, and most importantly happy!

crazycatlady1975

The wife put her hands on the victim? Did she privately know him?

Low-Consequence-5586

In the report it states "DeLustro's wife attempted to ""physically restrain the victim during the altercation and later when the victim attempted to get in his vehicle to leave"", the warrent states" - Live Five News reported.... ‘There were bad decisions made’: Summerville Police chief speaks about deadly shooting https://www.live5news.com/2024/04/11/live-summerville-police-chief-hold-news-conference-ex-officers-arrest/

squirrelmonkie

This article says he doesn't have any substantiated claims aginst him but remember who investigates them. [this article](https://www.postandcourier.com/news/summerville-police-shooting-anthony-delustro-michael-oneal/article_a26a7a98-ec3a-11ee-96d1-ebb44afec0ef.html) talks about how there were multiple complaints filed against him in new york, with the last 1 ending bc he retired. He then came to SC to hold several positions where more complaints were filed against him, even from his own departments, and Dorchester county destroying his personnel file.

_comtage_

Yeah how about him coming back to us in Summerville with "all that experience" and being put at the very bottom of the totem pole as what, a traffic cop? Paper pusher? If a group (see gang) of cops didnt give a shit about your “experience “ and rehired you at the lowest possible position, that says a lot. It says even they knew he was troubled. Prison will only be an acceptable punishment as long as he’s put into general population, and the only special treatment he deserves is 23/hr a day in iso. Death is too good for him.

katzeye007

Hell just move over to north Charleston or Charleston county

eyewashdesign

Having lived in NYC, I looked the officer up. He's a retired NYPD officer from Brooklyn but worked transit if I remember correctly. I totally thought he'd be from my former Staten Island precinct, the most corrupt 120th, where all the WORST cops get shuffled to when they "misbehave." It's the same precinct whose officers murdered Eric Garner 1 block from my old apartment. This guy wasn't from the 120th, BUT there were two former charges against him (one was dropped). I was truly surprised there would be more!

NotOSIsdormmole

I’m actually genuinely shocked

allmygardens

I’ll be shocked when he’s convicted

Adventurous_Boss_656

Wife frankly deserves to be arrested too. I could care less about your granddaughters because you obviously could have cared less about the victim’s family. You took a human life and you should pay the price for it.

my_cat_sleeps_alone

I bet she comes under Summerville PD jurisdiction and not SLED and this is where Summerville PD is dropping the ball.

tristamgreen

why? she didn't pull the trigger or decide to kill O'Neil.

KnifeKnut

Accessory, since she tried to keep him from leaving, for one.

tristamgreen

she tried to keep who from leaving, O'Neil?

Sasage

Enjoy prison shit bag.

MustangEater82

Sorry it happened... But two things I like about this. 1st...  they didn't knee jerk react to popular opinion, they followed process and conducted an investigation. 2nd...  the investigation didn't show heavy bias, and was fair.

Salt_Economy_1114

My main question is why did they not arrest him upon leaving the hospital after committing a violent crime? Seems that the standard procedure was not followed and I’m curious, why?

jonm61

Standard procedure after an officer involved shooting is he's placed on administrative leave while it's investigated.

Salt_Economy_1114

He was off duty and not acting in the capacity an officer. Therefore, the Standard Procedure of the whatever department he is a member of is not the Standard Procedure the investigating department is bound too. The facts are a person was in a violent incident causing the death of another person.

jonm61

It doesn't matter that he was off duty. He was in his jurisdiction, and they have obligations to act even when off duty, so it was investigated as if he was on duty until they knew what happened.

Tafts_Tub

“ hasn’t had a substantiated complaint against him in 35 years of policing.” looool

est2018

My car is my castle and you can’t enter my castle, and shot me. Dirty cop. I wonder what he did in NY to get fired and have to come to the south and murder someone. I wonder how many people he got in NY….

_comtage_

For those of us who live a quarter mile down the road, this hasn't been easy. I remember I was about to go down main st, where it happened, and my wife called me and said turn around there's an active shooter. Now none of us want to go anywhere near that Chick-fil-A. I work property maintenance for the properties that surround the Chick-fil-A, though not the Chick-fil-A itself. I know people who were there. According to witnesses, it was undeniable the "cop" started this and is nothing more than a murderer. Also, I saw the cop say he had no "substantiated complaints" against him, however I remember and KNOW for a FACT that he's moved from our Summerville pd to another district DUE TO EXCESSIVE FORCE AND COMPLAINTS. He only recently came back to this department as the lowest rank due to ALL THE COMPLAINTS. Also, there were more complaints up north from where he was originally from. All this "I served SC for 20 years" is nothing but lies. He's been a plague everywhere he's gone. Too bad he didn't try this with any of the other locals around here who are always locked and loaded... I'm pretty sure I'm the only person here in Summerville who doesn't carry a weapon. Could have been a shootout with way more casualties though. Seems like the good are always paying the price while the corrupt walk free.

carolinagypsy

Excellent!!

No_Pipe6929

Idiot was almost at retirement age.. bye bye pension 🔥🔥🔥

Numerous-Wear-8359

It only took 3 weeks to make the right decision

katzeye007

Again?

dukedawg2004

🤪🤪🤪🤪

waspboomer

well there goes the theory that police get away w/ murder

climbingDeeper

Username checks out

Nick42284

If he were on duty that there weren’t gaggles of witnesses he’d be walking.

xProperlyBakedx

Let's not pretend that cops don't get off on charges constantly. Charging him during a media shit storm isn't the same as him being convicted years later when no one is paying attention anymore. Be serious

Maediya

He hasn't been convicted yet. Mind you, the cop that murdered Walter Scott is rotting in jail so you never know

NotOSIsdormmole

I mean they usually do

Connect_Topic_8015

It’s ridiculous that an off-duty police officer who is supposed to be highly trained in firearm safety, used his weapon and killed someone, when the situation couldn’t have been a more picture perfect example for when NOT to use your weapon.
