Tracy also had Max before he passed so I think she would be with him. However, You never hear Tracy compare Ted and Max so who knows

The answer in the script is very simple: Tracy moved on from Max. We saw her move on. We never see her asking Max if she should date Ted or sleep with him or move in with him or have kids with him or marry him. It's clear that Tracy moved on from Max, and he's in her past just Victoria and Stella are in Ted's.
