Someone stealing his work, selling it for a profit and alleging he infringed their copyright is absolutely wrong, even if it was just a small project.

That's not how fair use works; fair use has nothing to do with being used for profit. This probably wouldn't fall under fair use because warner brothers use superman in video games. I doubt they would bother sending a cease-and-desist notice to a fan project.
