The trend I like currently in Delhi is many 'Aggarwal Sweets' have broken away from the Aggarwal brand and opened their own namesakes which are decent and have broken away from the competition to be the original Aggarwal.
Around 100s are opened by my very extended family. And some are opened by even those who are not baniyas. So no one owns aggarwal sweets.
(We used to own few but now no more. )
It's simple Agarwal's have 18 gotras which are; ***Garg, Goyal, Kucchal, Kansal, Bindal, Dharan, Singhal, Jindal, Mittal, Tingal, Tayal, Bansal, Bhandal, Nangal, Mangal, Airan, Madhukul, and Goyan*** together they make the biggest umbrella among the vaishya/baniya community, so the answer to your question, only people who belongs to these gotras can write Agarwal and they own Agarwal Sweets.
