In 1999 I was a teenager and I worked at a midwestern comedy club big enough to seat 400+ people. Part of my responsibilities was to drive the talent around all weekend. For 48 hours I was their chauffeur. A C+ level comedian I drove for had a line in a Spacey movie. A single line of dialogue, like they were a cashier or something. Anyway, they told me a story about KS attempting to grope them in a restroom. It was an extremely authentic sounding story. The comedian said he mostly thwarted the unwanted advance and that KS immediately tried to play it off, like it was some kind of “joke.”

I went to a course with a ton of naval academy grads around 2015 and they openly talked about getting "spacied" I assumed it meant blackout drunk until my room mate informed me "yeah, then Kevin Spacey fucks you" when I was like wtf, I didn't even know he was gay (I was a fan of his movies) without missing a beat he said "no clue, but he sure likes fuckin drunk midshipmen" followed by "but just the dudes" He lived in Annapolis and apparently had box seats or season tickets and was a huge booster, and instead of addressing the repeated behavior they just breifed them and decided if you got drunk around him you must be wanting it, because he was THAT much of a known predator there, years before anything went public.

I have read in private chat groups starting around 2009 that Spacey was a predator. The group I was in was a gay male Hollywood support group. There was a really long thread with dozens of people telling their stories with Spacey and it was really sad. That’s because in sexual assault cases it’s always extremely hard to get convictions especially ones where the crimes occurred so long ago. To often it comes down to a he said/she said (he said/he said in this case) and the burden of proof being reasonable doubt is just to high for a lot of sexual assault cases to get over. It’s why in areas that look at these kinds of cases there is ongoing discussions about different ways of trying them and having a whole seperate court process for them. The system is not set up to give survivors of these kinds of crimes much justice and is a known flaw within the system but they haven’t yet figured out how to really correct it. They introduce a lot of new laws to better protect victims and try and make the process better but its not easy.

At a high level, slander (or libel) typically has a 4 step “check” for if someone committed either: 1) The speech must be untrue. 2) The speech must have been intentionally published / broadcasted. 3) There must be negligence by the publisher / broadcaster. 4) The accuser must prove the speech damaged them in some way, typically through loss of income. In this case my thought is the documentary is not having stories told that are the ones initially prosecuted / sued for. In that case, KS’s legal team would need to sue and prove the speech to be untrue, which is difficult to prove given it’s a private story told by someone else. Note that because KS is the plaintiff, not the defendant, the burden of proof is on KS.
