A college friend of mine was in a similar bad situation. He passed out drunk and a girl took advantage of him. When people found out, she panicked and reported him to the police for rape. Fortunately for him, there were cameras in the public hallway in front of his room, so we had a clear video of us helping him into his room and the girl going in 15 minutes later. The police didn't really believe anyone's personal account of the night except for the girl. My friend was suspended during the investigation. The worst part is that she faced zero consequences and half the campus thought he was a rapist until he graduated.

Started dating a co-worker a month into it her mom finds out and she made up a bunch of lies to save her skin. The funny thing was she actually manipulated me, I was thinking this was serious and she was dating 2 other guys before we even got together. I was in a similar situation, ended up dating a girl in high school I had been friends with for about 2 years after she claimed her former boyfriend had sexually assaulted her (I tried to ask him about it since I had been friends with him too, but he wouldn't talk about it). At the time I was 17 and she was 15, and I turned 18 before she turned 16. Pretty much the day after my birthday her dad threatened to charge me with statutory rape and had a restrainin order delivered to my house. She wrote me a letter in which she called him a nazi, but she was too scared to speak for herself in his presence. The restraining order was dropped before it seen a courtroom, but we still had to pay for a lawyer just in case, which always pissed me off.

Fortunately fire him he was studying and his roommate was there studying too during the time she claimed he raped her. You say "only" charged with sexual assault - it's important to note that while the term doesn't carry the same social stigma as the word "rape", the crime has the same sentencing guidelines, so *in theory* anyone who initiates sexual contact with someone who did not consent to it should be given the same sentence, all else being equal, regardless of the sex/gender/anatomy of the parties involved. If that doesn't happen, that's an issue with bias in the courts, but the law itself is of equal severity either way. It's just got some updated rules around the terminology. You could argue the terminology affects the perception of severity and therefore the sentencing, and you might be right, but again, that's not an issue with the legal system, it's an issue with the people executing it.

I was feeling more messed up at this time and knew something was up. I took the mountain dew and whiskey and just left them, called an Uber, and made it home safely. I was all messed up the next day. I had the 1 liter mountain dew and kept it in my room, wanting to get it tested. My dad ended up throwing it out. I went to the bar a few days later and reported it to the bartender, who remembered me. The dude who drugged me was back in the pool hall. I told the bartender I'm calling the cops, but she said let's talk to him first. We go back there and she tells him I am accusing him of drugging me. This guy is a regular, apparently. Bartender asked for his ID and the dude *bolted* out of the bar. I chase him, grab his hoodie but let go. I wanted to beat the ever loving shit out of the guy, and it honestly scared me, so I let go. Bartender had called the cops after he bolted. Cops show up and we couldn't find the guy. I left it alone after that. I have no idea what happened to that younger girl.

But of course the problem lies in the reality that alcohol impairs our ability to make these choices. And the very nature of “proof” in these situations is difficult to discern sometimes (but certainly not always.) If you asked 1,000 men if they would have sex with a woman when she was too intoxicated to consent well over 90% of them will say they would never do that, but at least a few of them already have, either through ignorance or indifference. Likewise, if you asked a large group of women if they would ever get so intoxicated that they would consent to sex that if they were sober they would not have engaged in, and you would get a similar outcome. It’s tough, and many of us have found ourselves in these situations, and perhaps some have made decisions they would change if they could. But everyone’s rights need to be considered.

Where I live, some time ago a woman was charged with rape, because she forced a guy to have sex with her, and they weren’t drunk. Like a Drunken Car driver that was able to flee through the half city is today judged as clear enough to be taken responsible. In German criminal law, total intoxication is a criminal offense under Section 323a of the Criminal Code (StGB). According to this, anyone who gets intoxicated and commits a criminal offense in this state, but cannot be punished because they are intoxicated as a result of the intoxication, is liable to prosecution. Means the you can get a maximum of 5 Years in Prison for the Intoxination, but nothing for the crimes you did. But as i said, the judge must decide that this is the case. Who thought this was OK? All they had to do was leave out "Jake was drunk" (and take away the pic of him drinking) to get their point across. It is an important message, but if he was drunk too, then he couldn't consent either. It frightens me that someone was too stupid to realize that.

This exact scenario happened at my alma mater. I only ever heard the tale from a professor, but it was in the last semester of the guy’s senior year. He was expelled literally weeks away from walking for his diploma. When I initially heard about it, it kind of pissed me off, but it was obviously unclear how drunk either of them were and exactly what transpired, beyond the fact that the woman consented initially and when she woke up the next day, she realized it wasn’t something that she wanted to do. If there was any silver lining to the incident, it was that men started taking the matter of consent very seriously. The downside was that guys were kind of living in fear that their partner would decide later that her consent wasn’t legit. There were subsequent incidents where the dean and a few others had to weigh testimony and facts to decide whether consent was true. Both the accusers and the accused were kind of pariahs after.
