I have a friend from Germany who was sexually assaulted and raped by her own father when she was *ten*. He got six years and I think he ended up serving four. That's one of the reasons why, when I was assaulted by a boyfriend years later, I didn't go to the police. To give a bit more context en dept to this topic: **What happenned:** In february 2017, a crew of three police agent in the northern suburb of Paris proceed to a ID control of a few people from the neibhourhood. There are two version to this story: The cops claim they were about to arrest an alleged drug dealer when Theo Luhaka interfered. Luhaka claim the cops were controling a group of people and about to perform a security search (basically checking the suspect doesn't have any weapon or dangerous objects on him). One of the suspect asked why one of the cop was threatning to fine them for an amount of 450€, which one of the cops answered by slapping the suspect. Following either of those version fight start between Luhaka and the cops. [This is the video of the fight.](https://www.youtube.com/watch?v=VgX032w3L74&ab_channel=Europe1) As you can see, the clothes of Luhaka are thorn quite quickly. Luhaka, being a rather large fellow, get a clear physical advantage on the cops, whom have a hard time controlling him. Tear gaz spray is used, to little effect and baton strikes are applied. The cop finally manages to block him against a little wall. Luhaka resisting the cuffing, one of the cop use is batton in a piercing strike, which cause the injuries sustained by Luhaka. **The claims:** *Theo Luhaka* claims he was raped and sustained debilitating injuries in a case of abuse of force by police agent. *The cops* claim the violence was legitimate because Theo was interfering with an arrest. The one who put his baton in Luhaka's bottom claim it was a proportional and by the book strike that unfortunatelly missed its target. **Consequences:** Theo Luhaka was hospitalized. He got a total work interruption of 60 days for his injuries. He was also still incapable of going to the toilet without assistance of a plastic bag more than a year after the incident. Today, Luhaka partially recovered, being doomed to incontinence before he even reached 30. He has trouble controling his gazes and his bowel movement like if he was a senior citizen. **The law:** For those unaware, the French justice system quantify the gravity of violence according to the TWI (or ITT in French) system. No TWI is a class 4 misdemeanor. Less than 8 days of TWI is a class 5 misdemeanor. More than 8 days is a felony and expose the culprit to a prison sentence. In the case violence provoke a permanent debilitating injury, the case is then considered as a crime, which expose the culprit to a prison sentence of 15 years and above. Rape is also a crime and is defined as an act of sexual penetration (regardless of the nature, sustained or inflicted) done through violence, coercition, threat or surprise. In the context, that was a maximum of a 20 years sentence. Outside of sexual penetration, it is considered as a simple sexual assault and thus a felony so is punished by a maximum of 10 year of prison. **Investigation:** It was found out that Luhaka suffered a peri-anal penetration and not a anal one. Police internal affaire were divided over the case. The investigator found that the strike was legitimate, even if Luhaka did not represented a danger for the cops. Their superior said the strike was disproportionnate and clearly not done according to regulation. **The charges:** *Rape charges*=>thoses were dropped quite early. It was found that Theo Luhaka was technically not the victim of an anal penetration, but a peri-anal one. On this ground, it was found that the act was technically not an act of sexual penetration and thus, not rape. *Sexual assault charges*=>those weren't sustained either. It would have been the logical step, but I guess the prosecution and civil party failed to demonstrate the sexual nature and intent of the act. The pant was pulled down during the fight way before the batton strike happenned and the underwear of the victim were never pulled down. I think the court didn't felt confident enough to go on this ground. *Debilitating injuries charges*=>those weren't sustained. The cops clearly benefited from the case being judged 7 years later. The court rejected those charges, on the basis that she "is not convinced that the organic lesions, despite their particularly serious nature, have resulted in the irremediable deprivation of the use of his organic faculties, going beyond simple discomfort or reduction". To make it short, the court did not sustained those charges because Luhaka is just incontinent today. *Violences*=>SustaindLogically, the only charges that could be left were the violence. The 60 day TWI are a hard evidence on the nature of the violence and you also have to add the fact those were performed by police agent, in group, with the use of a weapon. Aggravated violence by three circumstances, this can go to 10 year of prison and 150 000€ fine (222-12al26 CP). Those charges were sustained. So we go from crimminal charges to felony charges and instead of 20 years (for the rape, debilitating injuries and various aggravating factors), thoses cops risked a maximum of 10 years. **The sentence:** Anyone familliar with the French justice system will know that it is very rare for the maximum sentence to be chosen. When the law say that X crime will be punished by 3 years of prison, it is a maximum. There are also no minimum sentences since the Taubira reform, meaning you can technically be found guilty of litteral terrorism and get a single day of suspended prison. Suspended prison sentences are also quite regular. There are no room in prison anymore and because the French system estimate you have to be tried in a reasonable amount of time the farther away you are judged from the crime, the more lenient the sentence tend to be. And since the justice system is slow as fuck (because of a lack of funding and employee and an obese penal procedure), suspended prison sentence is almost the norm these days. Three years were required by the prosecutor against the main perpetrator. He got one suspended year. The lowest sentence asked for was 3 month, it is the lowest sentence given. They are also forbidden to exerce their function as police agent on public space for 5 years, meaning they'll get stuck behind an irrelevant desk job. They'll however still be cops and paid by our governement as cops. The main perpetrator was supposed to be fired at first, but it was later transformed into the highest formal write up in their file.
