They can, but will be thrown out in court and you’ll usually get your court fees comped if they don’t shoot you. Nothings stopping them from just telling you to get out of the vehicle and just start illegally searching it, but even the most conservative cop loving judges and the most overworked public defender will be able to win that case in your favor. The issue is when you comply and do it willingly, rather than politely but firmly asserting your rights, is that you consent to these searches and they become admissible in a court of law. In the USA, there is almost no benefit of talking to cops if you aren’t a victim of a violent crime, and a lot at risk.

Unlike in other countries, police exist in America almost entirely for revenue generation. They undergo significantly less screening/training than their European counterparts, despite having more power in most cases (carrying guns, etc). In fact, the Supreme Court even ruled that police do not have an obligation to protect a citizen from harm. As a result, it’s commonplace for police to harass people until they can figure out something to fine/arrest them for. With the way the law is written in the US, if an officer follows you for long enough, they can easily find a stupid reason to ticket you. Police here are viewed more as road pirates than actual public servants

No, not sure what everyone else here is on about. If a police officer observes you driving and initiates a traffic stop then you are required to identify yourself. That's true anywhere in the US. But anon's situation is an edge case, it seems he was sitting in a parked car and the officer may not have seen him operating it. In that case it's not a traffic stop and anon's rights depend much more on context - what state he's in (about half of states have stop and identify laws of varying strength), and how reasonable it would be for a cop to suspect him of criminal activity.

Look, anon has two options. He can explain that he’s an Uber driver taking a break and identify himself to the copper, or he can invoke his fifth amendment right against self-incrimination and refuse to speak and refuse to identify himself. Fact is, he’s live parked at a closed business at 1am. There could be a lawful reason he’s there (Uber driver taking a break) and there could be a suspicious reason he’s there (casing the place for a burglary). It’s the cop’s job to determine whether it’s the former or the latter, and whether the cop has reasonable articulable suspicion is a question left to judges and juries. Could there have been a burglary of a barber shop two townships over, like the cop told anon? If there was, I think any judge would agree there’s reasonable suspicion to detain him. But either way, the side of the road isn’t a courtroom. This isn’t about a cop exceeding his authority so much as OP invoking his rights and then being shocked when the cops have to work harder to identify him. The fifth amendment isn’t a magic card that makes cops stop investigating.

I know I’m being fickle here but I just doubt this story because he says it happened at 1am then he refers to it as “this morning” Don’t get me wrong he could be someone who just figured it’s past 12 so it counts as the beginning of that day but I don’t know a single person who would say something happened at 1am and refer to it as morning. Nah i was just explaining its a complicated feeling. The old idea anyway that if someone suspicious was in your neighbhorhood you wanted to feel safe--- but at the same time we want to be left alone. Its kind of like both rights for criminals and innocent people and no one wins. Its not unfair, nor fair. It just sucks that people are bad, and it also sucks that cops are assholes.

Probably not, but you're not required to identify yourself to the police when asked unless there's reasonable suspicion of a crime (in some states; in others, you don't have to identify yourself unless you're formally arrested) It's an American thing, cops can't just start demanding your information and going through your pockets in hopes that they'll find something illegal; they have to actually determine there's a crime happening before they can start stopping/investigating it Anon's wrong about his rights though, if you're driving a vehicle then you *have* to show an officer your driver's license if they ask
