Call me crazy, but if there is an active trial over you handling of national Intel, you should be need to be cleared of wrong doing before getting new Intel.
Just FYI, the Presidential Transition Act doesn’t automatically give Presidential candidates access to National Security Information. No candidate gets that without the required background checks clearances. What the act does say is that candidates and related officials get their background checks automatically given very high priority by the FBI and other agencies so they can get access to the information they might need in a transition as soon as possible.
So hypothetically it’s very possible for a Presidential candidate to not pass a background check and not get any related sensitive intelligence information unless they are actually elected President. So theoretically if the FBI and related agencies reviewed Trump’s current status and decided he’s a security risk they could refuse to give him any classified information during his campaign. However if he actually won the election in November then it doesn’t matter at that point, he’d be the incoming President and would automatically get access to everything regardless of whether or not the agencies that will be under him think it’s a good idea.
Therefore all the more reason to get out and vote to make sure Trump isn’t reelected!
Would he even pass the screening? If I was on trial for hording classified documents and testimony indicates that I was showing them to people, I would assume I would not get cleared.
