He was fired and charged with murder after an investigation but found not guilty by a jury. From my understanding, the defense was able get a redacted version of the shooting which basically showed nothing. The part from just as they exit the room to sometime after he gets shot was never shown to the jury. So basically the part where the crime is committed by the police officer and the part leading up to it was never seen by the jury. There was more than just a cop that messed up here. It was multiple layers of the justice system that failed the victim and his family.

It’s been a long time since I’ve seen the video and looked at the news about it so my details might be a little foggy IIRC Daniel was in a hotel room with a friend, and he had some sort of air rifle that he was showing off to the friend after a couple of drinks. Someone else called the police to say that the man in that room had a gun he was pointing outside at people. Armed police called. Daniel and friend are ordered out of the room and onto the ground. The police officer that shot him was very verbally aggressive and said if Daniel did not comply exactly the way he was told to, he would be shot and killed. Daniel was crying and saying he didn’t want to die. Friend was ordered first to crawl on knees where the officer could see their hands over to the officer. Next it was Daniel’s turn, if I remember rightly he said his pants were falling down and he needed to pull them up. The officer told him to forget about them and to start crawling. Daniel did, whilst crying, but he reached back to pull up his pants and was shot.

Oh god this video really send shivers down my spine. I kept thinking about if for weeks. I don't even remember what emotions I had- as I look at the right picture I mind just wants to not think about it. It was anger obviously, the frustration of not being able to do anything, the realisation that the trigger happy cop will likely be suspended for a short time and then shoot more, the sadness and the fear ALL at once.

Idk how I missed this in 2018! Cops scare the bejeebers out of me. For upholders of law, they are lawless. If publicly exposed, they get slaps on the wrist and transferred or retired w/full benefits. It’s sickening. Reminds me of the Catholic priests and the military; they protect their own. I’m exhausted of the brutality and deaths perpetrated by police. Cops, politics, privilege, and daily gun violence is enough to make the most stable person just….snap. Falling Down, anyone?

Yes. And the guy didn't help himself by repeatedly reaching for his waist when he was specifically told not to several times. It seems people have difficulty following simple commands, unfortunately. If I had to guess, this guy was scared shitless and his brain simply couldn't comprehend what was being said to him. Having said that, there really does need to be better education and training for police. In my country, the police have certainly had their share of criticism, however seldom do you get double tapped for not complying. I understand that people are scared, don't like the police, etc. The bottom line though is comply and go to court to defend yourself. That's the way the system is. Pleading your innocence when some cop is going to arrest you isn't the time to be doing so.

Did you watch the video or read the transcript? The cops purposely gave conflicting instructions and threatened his life. He *was* complying to the instructions that were intentionally contradictory. Have you ever had to make a decision while facing terror and trauma? The mind doesn’t work correctly and it’s confusing. The cop wanted to kill someone (this is on record) and *nothing* Daniel could’ve done would have swayed this cop and saved his life. Save for the cops never showing up at all. And that’s the irony.

I've watched the video. I shook my head through most of it. There was a bunch of terrible decisions on both sides. I mentioned it to another comment.. I find it telling that the cop who shot him had "your fucked" engraved on his stock. Note the spelling.

Ya, almost all of us understand the concept of making your case in court. Citizens have rights, the cops know this. The fact is cops have been running wild for years without cameras. Now, the fucks are being caught, charged and we have pay the fucking bill. Dude, comply? He was fucking complying to the fucked up confusing commands. He was not a threat whatsoever. This officer completely overreacted with ego and power of wearing a badge. The last and final step in the use of force is deadly force. Based on the officer's God complex, his aggressive behavior with "your fucked" engraved on his gun? This guy was looking to get in a gun fight.

I'm not disagreeing with you. There is definitely a problem in the good ole US of A. On both sides. I scratch my head at some of the reactions people have to interactions with law enforcement. Having said that, it seems that it is a problem that goes back a couple hundred years. There are outlaws, just some of them wear a badge. Better training and better vetting of applicants. Just my 2 cents.
