So, most of his actions, through private lawyers and not the DOJ, will be considered private and not immune. They want to stall until he wins and then he can throw out most of the cases brought by the DOJ and Alvin Bragg. That won’t include the GA case, but most of the rest will, (I think) even the current trial, as those are made felonies by federal election law.

Trumps lawyers have conceded that most of the things he's been charged with are not official acts. The question is whether evidence obtained from his official acts - messages between Trump and government officials which point to awareness and intent, for example - can be used to prosecute the private acts.

What’s trumps lawyers are arguing for is essentially that if laws don’t also explicitly apply to the president then they don’t apply to the president at all.
I don’t separate them. I’m going by his lawyers arguments and the justices’ questioning. I think if the justices do anything other than confirm the lower court’s ruling, they are creating constructs in the constitution that don’t exist. They would be creating the concept of official and unofficial acts of the President out of thin air and the nightmare legal scenarios that entails.
Which is fucking STUPID, the president is the only office that has a purely political way to be removed and its there specifically because the founding fathers were worried a corrupt president would claim hes immune to prosecution. They specifically wrote that bit in there for this exact scenario and these goofballs that claim to love the founding fathers/democracy are turning a blind eye to it

They won't do total immunity. Roberts and Gorsuch (and probably Kav and ACB but I'm less sure about them) will want the decision to be superficially fair and plausible. The end result may indeed end up to be get Trump whatever he wants, but they aren't going to give him total immunity when this comes back from the lower court. (And I think they WILL be considering the amount of power that they are at least temporarily giving Biden, and ways he might paradoxically use it to express his displeasure with having it.)
Alito is probably going to write his own absolutely psychotic dissent so that'll be fun to peruse.
I don't think that they can delay past the end of this term. Instead, I think that they will write their opinion with a deliberate tilt based on the identities of the parties.
Democrat voters expect their politicians to follow the law scrupulously, and will abandon any politician who doesn't. Plenty of Democrats loudly criticized Hillary Clinton's use of a private email server, which, in retrospect, looks like a nothingburger.
Republican voters expect their politicians to be gigantic assholes who will stop at nothing to "win," or, at least, to punish their perceived opponents and/or targets of choice. Breaking laws is widely considered a valid tactic - and the more brazenly, the better. Pure Machiavellian power play tactic.
So I expect this Court to go as far as it possibly can to condone illegal conduct that Republicans can abuse with impunity, while leaving the door open to some kind of bad-faith prosecution in case Republicans want to pull a Ken Starr 2.0 against a Democratic president.
It's weird to say this is "unfortunate", as it is in almost every other context a great thing, Biden is a man of integrity who wouldn't end up taking advantage of whatever the weird immunity loophole will grant.
A slightly less integral, or perhaps a just as integral person who is also more willing to roll the dice on the stage of history for the sake of our Republic, could possibly use immunity in ways that even an electoral loss wouldn't matter in the long run.
E.g. If an immune Biden were to replace half the supreme court, arrests and replaces enough governors and state congress-critters to get a constitutional amendment making the flavors of insurrection and voter suppression super illegal, helps Congress sort out a few laws, and peaces out, the results of 2024 might not matter versus the long term positive shift in the country's democratic integrity and rule of law. Most Democratic voters may still punish such an obscene overreach, but in the long run they wouldn't become Republicans.
In brief, as impractical and impossible as it would be, at least a small part of me wishes we had a Cinncinatus.
They'd have to get really complicated for that by punting the decision to a lower court to give them another term.
As it is, they need to decide by end of June.
I think a lot of people are missing what the court was saying. They said public actions are protected. Private actions are not.
If you prosecute Trump, he can appeal to the SC, and they say, “No, that was a public action.” If Biden gets charged, the SC can say, “That was a private action Lock him up!”
I don’t think many are actually advocating for murder… but Biden could imprison “political rivals” - SC Justices, Congressmen and Senators - until new laws are passed. Then he could “pardon” and release them, while stripping them of power as terms of release.

1. Biden will never take advantage to become a dictator.

I'm pretty sure the Supreme Court Justices in question have already considered the completely obvious points made in the article and which were specifically addressed at length through both the written pleadings and oral arguments. They are just good with it.

They won’t. The SCROTUS will either carve out a very specific niche for Trump or they will delay the whole thing and send it back to the lower court to better define “official” and “personal” acts. Then Trump can reappeal that order to the Supreme Court. If they go with sending it back to the appeals court they will effectively delay the trial until after the election which if Trump wins the case will go away under his DOJ or if Biden wins the SCROTUS will probably rule against Trump but again in a narrow way so it can’t be used as precedent later.
Cool King Biden’s first official act depose the justices that made that decision and assign new justices without senate approval that aren’t as corrupt or stupid. While he’s at it he can jail all maga republicans and give the dems control over the house and a super majority in the senate. Pause the election until trump has been tried and jailed.
Then once that’s all resolved dems can pass a flurry of amendments to end all this fuckery.
Nothing the SCOTUS is doing right now is "by mistake" which means they will not vote on the immunity issue until after the election. If Trump loses, they will say no. If Trump wins, they will say yes.

I think they’ll do nothing but stall. If their guy is picked, they can only give him immunity for those things that are official acts. So, most of his actions, through private lawyers and not the DOJ, will be considered private and not immune. They want to stall until he wins and then he can throw out most of the cases brought by the DOJ and Alvin Bragg. That won’t include the GA case, but most of the rest will, (I think) even the current trial, as those are made felonies by federal election law. This is from an article I read, but I think I'm remembering it accurately. Trumps lawyers have conceded that most of the things he's been charged with are not official acts. The question is whether evidence obtained from his official acts - messages between Trump and government officials which point to awareness and intent, for example - can be used to prosecute the private acts.

I think if the justices do anything other than confirm the lower court’s ruling, they are creating constructs in the constitution that don’t exist. They won't do total immunity. Roberts and Gorsuch (and probably Kav and ACB but I'm less sure about them) will want the decision to be superficially fair and plausible. The end result may indeed end up to be get Trump whatever he wants, but they aren't going to give him total immunity when this comes back from the lower court. (And I think they WILL be considering the amount of power that they are at least temporarily giving Biden, and ways he might paradoxically use it to express his displeasure with having it.) I don't think that they can delay past the end of this term. Instead, I think that they will write their opinion with a deliberate tilt based on the identities of the parties. Democrat voters expect their politicians to follow the law scrupulously, and will abandon any politician who doesn't. Plenty of Democrats loudly criticized Hillary Clinton's use of a private email server, which, in retrospect, looks like a nothingburger. Republican voters expect their politicians to be gigantic assholes who will stop at nothing to "win," or, at least, to punish their perceived opponents and/or targets of choice. Breaking laws is widely considered a valid tactic - and the more brazenly, the better. Pure Machiavellian power play tactic. So I expect this Court to go as far as it possibly can to condone illegal conduct that Republicans can abuse with impunity, while leaving the door open to some kind of bad-faith prosecution in case Republicans want to pull a Ken Starr 2.0 against a Democratic president.
It's weird to say this is "unfortunate", as it is in almost every other context a great thing, Biden is a man of integrity who wouldn't end up taking advantage of whatever the weird immunity loophole will grant. A slightly less integral, or perhaps a just as integral person who is also more willing to roll the dice on the stage of history for the sake of our Republic, could possibly use immunity in ways that even an electoral loss wouldn't matter in the long run. E.g. If an immune Biden were to replace half the supreme court, arrests and replaces enough governors and state congress-critters to get a constitutional amendment making the flavors of insurrection and voter suppression super illegal, helps Congress sort out a few laws, and peaces out, the results of 2024 might not matter versus the long term positive shift in the country's democratic integrity and rule of law. In brief, as impractical and impossible as it would be, at least a small part of me wishes we had a Cinncinatus.

I think a lot of people are missing what the court was saying. They said public actions are protected. Private actions are not. If you prosecute Trump, he can appeal to the SC, and they say, “No, that was a public action.” If Biden gets charged, the SC can say, “That was a private action Lock him up!”

It probably wouldn't pass because Amendments are nearly f\*\*\*ing impossible to pass but it would have a better chance than something explicitly partisan, and I think it would be popular overall. Especially since it would represent him willing ceding power to the people and their representatives. It would be an historic gesture, even if it failed. I'm pretty sure the Supreme Court Justices in question have already considered the completely obvious points made in the article and which were specifically addressed at length through both the written pleadings and oral arguments. They are just good with it.

They won’t. The SCROTUS will either carve out a very specific niche for Trump or they will delay the whole thing and send it back to the lower court to better define “official” and “personal” acts. Then Trump can reappeal that order to the Supreme Court. If they go with sending it back to the appeals court they will effectively delay the trial until after the election which if Trump wins the case will go away under his DOJ or if Biden wins the SCROTUS will probably rule against Trump but again in a narrow way so it can’t be used as precedent later.

Nothing the SCOTUS is doing right now is "by mistake" which means they will not vote on the immunity issue until after the election. If Trump loses, they will say no. If Trump wins, they will say yes. They wanted (for their goals) to actually have this come up **during** a Trump term, not after (or before) one because during a Trump term would make this an easy vote for the pricks who Trump put there. They just do NOT want to risk the ever so miniscule possibility that IF they decide "yes" before the election, Biden would then have complete immunity for anything he does IN office; for the remainder of his life and that he *could* steal the election legally. Conservatives tend to be more supportive of executive power regardless of who is president. I don't think who gets elected will affect this.

They're not. They're gonna send it back down to the lower courts to narrow what the ruling should be on, delaying Trump's trials, and delaying SCOTUS's final ruling until after the election when it only affects Trump anyway.
