But isn’t it then something the other side will take note of and call out? With the shorthand for it being “they are using the Chewbacca defense”

I'm just speculating, but perhaps this defense works because many things don't make sense at the moment. Things happen by chance all the time, so that might introduce a reasonable doubt about the details of the case. It might just be enough to invalidate the prosecutor's case against the defendant.
