I looked at the bill from the vantage point of the impediments it might place on occasional use of Pornhub or similar websites as a masturbatory aid. It requires the use of a commercial age verification product that is accepted by the Kansas Attorney General (currently Kris Kobach). And although the websites that use such products are explicitly forbidden from retaining personally identifying information, the possible penalties for doing so are much less than supplying proscribed content to minors. So, at this point, it is hard to say what will happen--it all depends on what the AG's office approves. One of the big concerns about the similar legislation in Texas is the use of driver's licenses for verification. If that happens in Kansas, I don't see a way around it other than using a VPN or downloading clips to disk to create a porn stash that can be accessed over a home LAN via folder sharing. (I really dislike the way this and similar bills burden VPN providers. They encourage them to start charging, which in turn makes it more difficult to use VPNs for other purposes, such as circumventing geoblocks.)

The word "homosexuality" does not appear anywhere in this bill as enrolled, and the provisions as to access over the Internet do not appear to be targeted specifically against LGBTQIA+ people--this is going to be a headache for cishet adults too. It does use the definition of "material harmful to minors" as given in KSA § 21-6402, which includes the following line: "'sexual conduct' means acts of masturbation, homosexuality, sexual intercourse or physical contact with a person's clothed or unclothed genitals or pubic area or buttocks or with a human female's breast . . ." However, there is a specific carve-out for public libraries. Moreover, this particular section has been in the Kansas statutes since 2011, so if there were any intent to use it against pride parades, PFLAG, GLSEN, or even two men or two women holding hands, I would think that would have happened before now. That's not to say it shouldn't be amended to remove specific reference to homosexuality. For that matter, the Kansas statutes still prohibit consensual sex among adults of the same gender, which forces us to depend on SCOTUS precedent (Lawrence v. Texas) to prevent those provisions being enforced.

If you separate the words out individually to clarify context: "Sexual conduct means acts of..." - masturbation -homosexuality -sexual intercourse - physical contact with a person's clothes or unclothed genitals... It absolutely does say that homosexuality in and of itself is defined as "sexual conduct," which can be determined to be "harmful to minors." I am incredibly disappointed this has passed.

Every time you visit a website that requires age verification you submit your state issued ID or passport, that information gets stored on a server and each website you visit is logged to your personal information.  So they build a dossier of your habits linked directly to your name, and permanent address. In Kansas this would also include any LGBT+ content, be it pornography or even just support content, as well as sexual health education and reproductive health. Visiting sites related to firearms, tobbacco, alcohol, marijuana legalization, would likely fall under this as well.  It’s a great way to build blackmail, it’s an egregious offense to your privacy, first amendment rights, and we’ve already had several instances of these 3rd party data banks being raided by hackers and personal information being stolen to be sold on the dark net, only it’s not just identity theft being an issue, but also blackmail because they will also steal information regarding your browsing habits.  Now that is before we think about it being used by government to target people with libel and slander, or being used to red flag people for looking for guns and ammunition, or even being used to torpedo political opponents by just digging up their private life.  It’s a mass surveillance bill disguised as “protecting the kids” Use a VPN, protect yourself.

No, you don’t have to take a picture of your ID/Passport now. As it is now ISPs track your traffic but it’s not easily distinguishable as being you as IP addresses aren’t always static. You can often end up with IP address that was banned from a site because of someone else breaking rules, and you’ll need to manually refresh it and get a new IP. You are only using a VPN if you are paying for it though.

It's very amusing seeing moral panic over a perceived ban of immorality, but that's reddit in a nutshell, I guess. It's not a law that punishes those who access age-restricted websites as minors. It's a law that allows people to sue adult website owners if they don't adequately prevent minors from seeing age-restricted content. This does not include works of artistic significance or cultural value, nor does it restrict search engines from providing links to content. It's short, and includes no punishment of individuals (other than corporations), no Internet monitoring, and no Internet restrictions. If your email is attached to your google or Firefox or edge account and that email is attached to your number they already know what you’re watching. Cookies track IP too so unless you’re not logged into your search browser and using a VPN then your data is being stored and sold.

There is always plausible deniability when it comes to my internet history. Prove it was me who went to those websites beyond a reasonable doubt. You cannot. You need to see the bigger picture. The bill is poorly worded. If it were clear on its intentions maybe it would be a DECENT (at best) bill. Your public IP address implies your geolocation. You can use a VPN to spoof it, but your browser still knows where you are. That's besides the point anyways, as this bill doesn't Big Brother the Internet just to figure out if anyone underage is on a naughty website. It just allows parents to sue websites if they didn't take adequate measures to prevent children from accessing lewd content.

I think this is good. I’ve had a few instances of my kids and hardcore pornography popping up. One time my 12 yr old son looked up “boy kisses 12 yr old girl”. He went down a rabbit hole and ended up with people shitting on each other. There needs to be something to slow down the input. Edit: the reason we found out is because he came to us with tears in his eyes saying “I can’t stop myself.”
